By accessing or using our website, mobile applications, booking platforms, or any services operated by Rooftop Royale ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not access or use our services.
These Terms of Use constitute a legally binding agreement between you and Rooftop Royale, a company based in Cleveland, Ohio. By creating an account, purchasing a membership, booking access to any rooftop venue, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these terms.
Rooftop Royale operates a membership-based rooftop experience network. Access to our venues and services requires an active membership or authorized day pass. To be eligible for membership, you must:
We reserve the right to accept, decline, or revoke membership at our sole discretion without obligation to disclose the reason.
Rooftop Royale offers multiple membership tiers, each with distinct access levels, pricing, and benefits as described at the time of purchase. Membership fees are billed on a recurring basis according to the billing cycle selected at enrollment. You authorize us to charge your designated payment method for all applicable fees.
Membership fees are non-refundable except where required by applicable law or as expressly stated in a specific promotional offer. We reserve the right to modify membership pricing with at least thirty (30) days' advance notice to active members.
Access to specific rooftop venues is subject to availability and may require advance reservation. Rooftop Royale reserves the right to modify venue availability, operating hours, and capacity limits at any time. Failure to honor a reservation without adequate notice may result in forfeiture of the reserved access and, in the case of repeated occurrences, suspension of membership privileges.
All members and guests are expected to conduct themselves in a manner consistent with the premium, respectful environment that Rooftop Royale maintains. Prohibited conduct includes but is not limited to:
Violation of this code of conduct may result in immediate removal from the premises, suspension, or permanent termination of membership without refund.
All content on the Rooftop Royale website and applications, including text, graphics, logos, images, and software, is the property of Rooftop Royale or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
Rooftop venues involve inherent risks including but not limited to exposure to weather, elevated heights, and varying surface conditions. By accessing any Rooftop Royale venue, you voluntarily assume all risks associated with such access. To the fullest extent permitted by Ohio law, Rooftop Royale shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services or venues.
Our total liability for any claim arising out of or relating to these terms or our services shall not exceed the amount you paid in membership fees during the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Rooftop Royale, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of our services, violation of these terms, or infringement of any rights of a third party.
You may cancel your membership at any time through your account settings or by contacting our membership team. Cancellation takes effect at the end of the current billing cycle. We may terminate or suspend your membership at any time for violation of these terms or for any other reason at our discretion, with or without notice.
We reserve the right to update or modify these Terms of Use at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after any modifications constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved exclusively in the state or federal courts located in Cuyahoga County, Ohio.
